<p>First-time homebuyers will have until Sept. 30 to close on their purchases and land an $8,000 tax credit under a bill passed by the Senate late Wednesday.</p>
<p>President Obama is expected to sign the bill, which was overwhelmingly approved by the House on Tuesday. The deadline had been June 30.</p>
<p>The bill doesn&#8217;t help anyone currently shopping for a home. Buyers must have signed a contract by April 30 to qualify for the tax break. At issue is when the deal must be finalized.</p>
<p>Qualified existing homeowners also have until Sept. 30 to close on new homes and receive a tax credit of up to $6,500.</p>
<p>Congress has been trying to pass the extension for the last month, but it got caught up in Washington politics. Only when it was separated from a larger jobs bill did deficit-wary lawmakers sign off on it. The extension will only raise the deficit by $9 million.</p>
<p>An estimated 200,000 people have missed out on the tax credit because they wouldn&#8217;t have been able to close by the end of business Wednesday. Many are trying to take advantage of short sales, which are complicated deals to complete.</p>
<p>The Senate approved the stand-alone homebuyers tax credit shortly after a failed attempt to advance a bill that combined the credit with an unemployment benefits extension.</p>
<p>Senate Majority Leader Harry Reid, D-Nev., said the chamber will take up the benefits bill again once a replacement for the late Senator Robert Byrd, D-W.Va., is named. Byrd, the longest serving member of Congress in history, died Monday at age 92.</p>

<p>With the cutoff to qualify for a federal tax credit fast approaching, Congress wants to delay the deadline for consumers scrambling to close transactions.  Congress is considering an extension for would-be homebuyers who are racing to close home sales in order to receive a federal <a href="http://myrebroker.com/wp-admin/#" target="_blank">tax credit<img style="margin: 0px;width: 10px;float: none;height: 10px;border-width: 0px;padding: 0px" src="http://images.intellitxt.com/ast/adTypes/2_bing_11pxw.gif" alt="" width="11" height="10" /></a>.</p>
<p>The real-estate industry has warned that tens of thousands of buyers who rushed to buy homes to qualify might not close before the deadline imposed by Congress, meaning they could miss out on receiving credits worth thousands of dollars if lawmakers don&#8217;t act.</p>
<p>Congress last fall extended an $8,000 tax credit for <a href="http://myrebroker.com/wp-admin/#" target="_blank">first-time homebuyers<img style="margin: 0px;width: 10px;float: none;height: 10px;border-width: 0px;padding: 0px" src="http://images.intellitxt.com/ast/adTypes/2_bing_11pxw.gif" alt="" width="11" height="10" /></a> and added a smaller $6,500 credit for current homeowners who were buying a primary residence. To qualify for the credit, buyers had to sign purchase contracts by April 30 and must close on the transaction by June 30.</p>
<p style="background-color: white;margin-top: 0in;padding-right: 0in;margin-bottom: 0pt"> But there are so many transactions in the pipeline that the companies responsible for handling the sales, including mortgage lenders, appraisers and title insurers and real-estate brokers, say the last-minute homebuying rush in April has created bottlenecks.</p>
<p>Senate Majority Leader Harry Reid (D., Nev.) last week said he would back a measure to extend the June 30 closing date to Sept. 30 for buyers who had met the April contract deadline.</p>
<p>The <a href="http://myrebroker.com/wp-admin/#" target="_blank">National Association of Realtors<img style="margin: 0px;width: 10px;float: none;height: 10px;border-width: 0px;padding: 0px" src="http://images.intellitxt.com/ast/adTypes/2_bing_11pxw.gif" alt="" width="11" height="10" /></a> estimates that from 55,000 to 75,000 homebuyers who are under contract won&#8217;t be able to close in time to claim the tax credit. The trade group is lobbying Congress to extend the June 30 deadline only for those buyers who met the April deadline.</p>
<p>&#8220;Everybody who got under contract at the end of April deserves to get the tax credit,&#8221; says Stephen Adamo, the president of Weichert Financial Services, a division of real-estate brokerage Weichert Realtors. &#8220;For reasons out of their control, they&#8217;re in jeopardy of losing it.&#8221;</p>
<div>That is causing heartburn for buyers like Alan Nickelson, a first-time homebuyer who went into contract on a <a href="http://myrebroker.com/wp-admin/#" target="_blank">three-bedroom home<img style="margin: 0px;width: 10px;float: none;height: 10px;border-width: 0px;padding: 0px" src="http://images.intellitxt.com/ast/adTypes/2_bing_11pxw.gif" alt="" width="11" height="10" /></a> in Kent, Wash., days before the tax-credit deadline in April. While he was pre-approved for a loan and will make a 20% down payment on the $275,000 home, he says the transaction has been held up because of home inspections and repairs required by the appraiser.</div>
<p> </p>
<p>Nickelson says it is &#8220;entirely possible&#8221; that he will miss out on the tax credit. He says he would have bought the home anyway but that he planned to use the $8,000 credit to offset repair costs. &#8220;It was icing on the cake, but it was really sweet icing,&#8221; says the 52-year-old machinist.</p>
<div>One particular worry is that short sales, where a lender allows a home to sell for less than the amount owed, won&#8217;t receive requisite approvals in time to meet the closing deadline. Unlike normal sales, in which only two parties &#8212; the buyer and the seller &#8212; negotiate the price, short sales are more time-consuming affairs because they require note-holders to agree on price.</div>
<p> &#8221;From February on, I told people, you have no chance&#8221; of finishing a short sale by June 30, says Steve Capen, a real-estate agent in St. Petersburg, Fla. But he says clients who began pursuing deals even before that could still miss the deadline.</p>
<p>Real-estate agents say that even &#8220;plain-vanilla&#8221; transactions are increasingly at risk. Response times from loan officers and appraisers have doubled over the past month, says Kailee Rainey, who works for real-estate brokerage in Seattle.</p>
<p>Lee Barrett, the president of Century 21 Barrett, a real-estate company in Las Vegas, spent part of the week in Washington meeting with his congressional delegation about the need to extend the closing deadline. &#8220;The lenders are overwhelmed. The title companies are overwhelmed,&#8221; he says. &#8220;It&#8217;s just a mad surge of everybody trying to close deals.&#8221;</p>
<p>At Wells Fargo, employees from other sales divisions are being brought in to handle mortgages, and staff members are working weekends and nights to process higher volumes. &#8220;It&#8217;s all hands on deck,&#8221; says Greg Gwizdz, an executive vice president at Wells Fargo Home Mortgage. He says the bank has prioritized &#8220;every customer who qualified for the tax credit.&#8221;</p>
<h2>A 23% boost</h2>
<div>A spokeswoman for Bank of America says the lender is also placing &#8220;increased priority&#8221; on loan applications submitted before the April 30 deadline. Luke Hayden, the president of PHH Mortgage, a lender in Mount Laurel, N.J., says consumers can help speed the process along by being &#8220;very responsive to requests for documentation&#8221; from lenders.  </div>
<p>Some of the delay reflects new rules related to disclosure and appraisal requirements enacted to correct the excesses of the bubble years. The new regulations have prompted lenders to take extra caution at every step, stretching closing timelines.</p>
<p>The tax incentive was credited with boosting existing-home sales in April by 23% from year-earlier levels, according to the NAR, while new-home sales gained by 47.8% from one year ago, according to government figures.</p>

<p>The U.S. House of Representatives approved H.R. 2454, the American Clean Energy and Security Act by Reps. Waxman (D‐CA) and Markey (D‐MA). Following NAR’s long‐standing policy to only take a position on legislation, or provisions within legislation that have a direct affect on real estate, NAR worked with our Congressional allies to strip the Energy Bill of provisions that would have adversely affected our industry.</p>
<p>After multiple consultations with the NAR Climate Presidential Advisory Group, the NAR Land Use, Property Rights and Environment Committee, and state associations who had dealt with energy audit legislation at the state level, the Land Use, Property Rights and Environment Committee directed NAR staff to concentrate on the real estate provisions in the bill.  As a result, NAR issued calls for action and made this a talking point for Capitol Hill visits during its recent Midyear meeting.</p>
<p>Overall, REALTORS® succeeded in making a number of positive changes affecting the real estate provisions of the bill. The House‐approved bill:</p>
<ul>
<li>Does <strong><em>not</em></strong> create a federal energy audit requirement for real property;</li>
<li>Exempts existing homes and buildings from any federal guidelines for new construction energy efficiency information labels.</li>
<li>Prohibits the implementation of any labeling during a sales transaction.</li>
<li>Leaves the decision to states as to whether to require energy audits, disclosures, etc.</li>
<li>Provides property owners with significant financial incentives, matching grants and tools to make property improvements and reduce their energy bills;</li>
<li>Prohibits the Environmental Protection Agency from regulating residential and commercial buildings under the Clean Air Act;</li>
<li>Eliminated an early proposal to allow citizens to sue over minor climate risks under the Clean Air Act; and</li>
<li>Establishes green building incentives for HUD housing, including a loan program for renewable energy, block grants and credit for upgrades in mortgage underwriting.</li>

<div id="y-article-bd"><!-- Article Related Media -->For borrowers who are making their payments on time but are on the verge of default, the Obama administration&#8217;s loan modification program can reduce their credit score as much as 100 points. That makes it harder to get a loan and can present a problem when applying for a new job.</div>
<p>Housing counselors say it&#8217;s unfair, especially because the news often comes as a surprise to homeowners.</p>
<p>&#8220;Why should people&#8217;s credit be hurt even worse when they&#8217;re trying to do the right thing?&#8221; said Eileen Anderson, senior vice president at Community Development Corp. of Long Island, a housing counseling group in New York.</p>
<p>And many homeowners are angry that a program designed to help carries such a penalty, said Kathy Conley, a housing counselor with GreenPath Inc., a nonprofit group in Farmington Hills, Mich.</p>
<p>&#8220;It&#8217;s a feeling of being duped,&#8221; she said.</p>
<p>Still, the impact is far less severe than a foreclosure, where borrowers typically find their credit is in tatters for years. That&#8217;s due to the cumulative impact of many months of missed payments and the foreclosure itself, which drags down a homeowner&#8217;s&#8217; credit by 150 points or more on a scale of 300 to 850.</p>
<p>To enroll in the Obama administration&#8217;s $75 billion &#8220;Making Home Affordable&#8221; program, borrowers enter a trial period in which they make at least three payments. But some are finding out that their credit score takes a dive during this trial phase. It happens once their mortgage company notifies the three big credit bureaus &#8212; Experian, Equifax and TransUnion.</p>
<p>For delinquent borrowers, the damage was done when they fell behind on their loans.</p>
<p>But for homeowners who are having financial troubles but managing to pay their bills, a request for a loan modification is the first sign of difficulty. And that means a sharp drop in the borrower&#8217;s credit score.</p>
<p>The credit rating industry defends the practice. People who sign up for loan modifications would not be asking for help unless they were having severe money troubles, said Norm Magnuson, spokesman for the Consumer Data Industry Association, a trade group in Washington that represents the credit bureaus.</p>
<p>&#8220;The consumer is going into the program because they&#8217;re in a financial bind,&#8221; he said. &#8220;Other lenders would need to be aware of that.&#8221;</p>
<p>The Obama administration acknowledges that enrolling in the program can hurt credit scores. But Meg Reilly, a Treasury Department spokeswoman, said that foreclosure &#8220;brings far more serious financial consequences for borrowers and their families.&#8221;</p>
<p>The credit score issue is an unexpected consequence of the program that has been plagued with problems and disappointing results since its launch last year. Only about 170,000 homeowners had completed the process as of February. Hundreds of thousands more are still in limbo.</p>
<p>Jim Owens, 46, of Harrisburg, Ore., was accepted on a trial basis for the Obama plan last year.</p>
<p>He and his family were in bad financial shape. They were barely able to pay the mortgage and utility bills.</p>
<p>The main reason: After being laid off and unemployed for six months, he took a job as maintenance director at a retirement home. But it paid only around $25,000 year, about $10,000 less than his former job in a city public works department.</p>
<p>He and his wife were also struggling with debt, after taking out a second mortgage four years ago to pay off debt and medical bills.</p>
<p>Late last year, he was searching for a used sport-utility vehicle. He got a 30-day approval for $2,000 car loan.</p>
<p>But that time ran out before he found a car, so he had to reapply for the loan. He was shocked to learn that, after signing up for the Obama plan, he was denied.</p>
<p>&#8220;I should have been told,&#8221; that this might happen, Owens said. &#8220;Without credit, you can&#8217;t do a whole lot in life.&#8221;</p>
<p>A Citi spokesman, Mark Rodgers, said the company follows the Treasury Department&#8217;s guidelines for reporting to credit bureaus. &#8220;We do not determine credit scores,&#8221; said Rodgers, who declined to comment on Owens&#8217; case.</p>
<p>The impact is worse for borrowers who enroll in the Obama program and are then ruled ineligible.</p>
<p>If homeowners do manage to get accepted into the Obama program and have their loans permanently modified, lenders update the credit bureaus. The new status neither hurts nor helps the borrower&#8217;s credit score. Over time, they can see their score increase.</p>
<p>&#8220;The best way to build credit back is to continue to pay bills as agreed, to use credit wisely,&#8221; said Tom Quinn, vice president of scoring solutions at Fair Issac Corp., which designed the well-known FICO score system. &#8220;As time goes on, the score gradually increases.&#8221;</p></div>

<p>In answer to the question: &#8220;so how&#8217;s the Prescott real estate market going?&#8221;</p>
<p>Well, last month units sold were up 48% over the same month in 2009 &#8211; that&#8217;s 7 straight months of year to year growth</p>
<p>Gross sales and median prices were down, but that&#8217;s expected with the buyers market we are in, and the number of foreclosures and short sales (i.e. motivated sellers).</p>
<p>Good news is that whereas last year at this time we had 27 months of inventory, we are now down to 15.  And that should get better as we get into the more active spring and summer months.</p>
<p>As long as we can continue to reduce our inventory, we are on the path to a more stable real estate market.</p>
